Terms of Service

1. Acceptance of Terms

By accessing, enrolling in, or using the Pet Pal Wellness Membership or related services provided through this website (the "Website"), you agree to be bound by these Terms of Service ("Terms"). The Website and membership are operated by PAWsynergy Health & Fitness LLC ("PAWsynergy," "we," "us," or "our"). Payments and scheduling are operated on our behalf by Strategic Investment Partners Inc. d/b/a MyPrimaryCare ("Platform Partner"). If you do not agree with these Terms, do not enroll in or use our services.

2. Description of Services

PAWsynergy provides non-medical, in-home pet wellness services such as scheduled wellness visits, behavior support, and personalized care plans. PAWsynergy does NOT provide veterinary medical services. All veterinary care, diagnosis, prescriptions, and clinical advice are delivered by independent licensed veterinarians through Go Lexi Pet Telehealth (operated via the MyPrimaryCare platform). The Pet Pal Wellness Membership bundles in-home visits with access to Go Lexi pet telehealth.

Service area is limited to Lakewood Ranch and Manatee County, Florida. PAWsynergy reserves the right to decline service outside this area.

3. Eligibility

  • You are at least 18 years of age
  • You have legal authority to enter into this agreement
  • You are the legal owner or authorized caretaker of the enrolled pet(s)
  • Information you provide during enrollment is accurate and truthful
  • You are the authorized user of the payment method provided

4. Subscription and Billing Authorization

Membership pricing is $249 per month for the first pet and $100 per month for each additional pet. When you enroll, you authorize PAWsynergy and our Platform Partner to charge the payment method you provide on a recurring monthly basis. Charges are processed by Stripe via the MyPrimaryCare platform and may appear on your statement as "PAWsynergy," "MyPrimaryCare," or "Strategic Partners." You authorize recurring charges until your membership is canceled and agree to maintain accurate, valid billing information.

5. Non-Refundable Fees

Once your payment has been processed, we begin onboarding and scheduling services on your behalf. All membership fees are non-refundable without exception. This policy applies once a charge has been processed and onboarding or services have begun.

6. Cancellation Policy

You may cancel your membership at any time by submitting a cancellation request by email to pawsynergyhf@gmail.com. Please include sufficient information to identify your account. Upon receipt, we will de-enroll you from future billing. Cancellation does not result in refunds for charges already processed.

7. No Veterinary Relationship; Emergencies

PAWsynergy is not a veterinary practice. Our team does not diagnose illness, prescribe medication, or perform medical procedures. Veterinary care is provided exclusively by licensed professionals through Go Lexi Pet Telehealth. If your pet is experiencing a medical emergency, contact a licensed veterinarian or emergency animal hospital immediately. Do not rely on our Website or in-home visits for emergency care.

8. Assumption of Risk and Release

In-home pet care involves inherent risks, including but not limited to pet behavior, allergies, escape, injury, or property damage. You represent that your pet is up to date on core vaccinations and has no known history of aggression that has not been disclosed in writing. To the fullest extent permitted by law, you release PAWsynergy and its team from claims arising out of your pet's behavior, undisclosed medical conditions, or property conditions at the service location.

9. Fraud Prevention and Payment Authorization

By enrolling, you represent and warrant that you are the authorized user of the payment method used, you personally consent to the purchase, and no unauthorized person is using your payment method. You agree to indemnify and hold PAWsynergy and its Platform Partner harmless from any fraudulent or unauthorized payment activity.

10. Chargebacks and Payment Disputes

If you initiate a chargeback or payment dispute for services that have already been provided or made available to you, we reserve the right to pursue recovery of unpaid fees, associated damages, court costs, and reasonable attorney's fees.

11. Arbitration Agreement

Any dispute, claim, or controversy arising out of or relating to these Terms, the Website, the Pet Pal Wellness Membership, or services provided shall be resolved exclusively through binding arbitration. Arbitration shall take place in the State of Indiana (the home jurisdiction of our Platform Partner) and shall be conducted in accordance with the rules of the American Arbitration Association (AAA). By agreeing to these Terms, you waive your right to a jury trial and to participate in any class action lawsuit or class arbitration.

12. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of Indiana, without regard to conflict-of-law principles. In the limited event a claim cannot be arbitrated and relates to in-home services performed in Florida, you and PAWsynergy consent to the exclusive jurisdiction of state courts located in Manatee County, Florida.

13. Limitation of Liability

To the fullest extent permitted by law, PAWsynergy Health & Fitness LLC, Strategic Investment Partners Inc., Go Lexi, and their respective officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the use of the Website or services. Our aggregate liability shall not exceed the total amount paid by you during the three (3) months preceding the event giving rise to the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless PAWsynergy Health & Fitness LLC, Strategic Investment Partners Inc., Go Lexi, and their respective officers, directors, employees, partners, and affiliates from any claims, damages, losses, liabilities, costs, or expenses arising out of your use of the Website, your violation of these Terms, fraudulent use of payment information, or misuse of services.

15. Changes to Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Website after changes are posted constitutes acceptance of the revised Terms.
